Thomas C. Atmore

 

Tom focuses his practice on complex litigation, personal injury, and appellate practice, including national and international arbitration and class actions. He has successfully handled cases in various state and federal courts throughout the United States, trying cases to verdict before judges and juries and to decision in innumerable arbitrations. A sample of cases:

  • D&O coverage – Successfully sued for coverage under D&O policy (trial court granted summary judgment; case on appeal).
  • Insurance Bad Faith – Successfully pursued insurance company regarding improper claim handling resulting in damage to its insured.
  • Shareholder Suit – Successfully pursued claim of fraud in the inducement in selling option in closely-held company.
  • Product Liability – Successfully pursued manufacturer for failure to safely design a product and warn of risks associated with the product’s use resulting in injury to plaintiff.
  • Shareholder Suit – Successfully pursued claim of mistake in sale of stock in closely-held company.
  • Insurance Coverage – Successfully pursued claim for loss of “intangible” computer data.
  • Successfully pursued claims in federal court and under international arbitration rules against European manufacturer on behalf of distributor.
  • Successfully defended condominium association board against claims of breach of fiduciary duty.
  • Successfully defended heirs of estate at trial against claims of undue influence.
  • Successfully defended lender at trial against claims of negligence and breach of duty during commercial property receivership.
